1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Hostao LLC, a Wyoming limited liability company ("Company", "we", "us", or "our"), concerning your use of the CookieSeal service ("Service") available at cookieseal.com and its associated applications.

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

2. Description of Service

CookieSeal is a cookie consent management platform that helps website owners comply with privacy laws including the EU General Data Protection Regulation (GDPR), India's Digital Personal Data Protection Act (DPDPA), California Consumer Privacy Act (CCPA), and other applicable data protection regulations.

Our Service provides:

• Cookie consent banners for websites
• Consent logging and record-keeping
• Customizable consent experiences
• Analytics and compliance reporting
• API access (Pro and Business plans)

3. Account Registration

To use our Service, you must:

• Be at least 18 years old or the age of legal majority in your jurisdiction
• Provide accurate, complete, and current registration information
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account

You are responsible for safeguarding your account password and for all activities that occur under your account.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws, regulations, or third-party rights
• Upload, distribute, or facilitate distribution of illegal content
• Interfere with or disrupt the Service or servers/networks connected to the Service
• Attempt to gain unauthorized access to any portion of the Service
• Use the Service for fraudulent or deceptive purposes
• Reverse engineer, decompile, or disassemble any part of the Service
• Remove, alter, or obscure any proprietary notices or branding
• Use the Service to spam, harass, or harm others
• Violate any robot exclusion headers or bypass rate limiting measures

5. Service Plans and Billing

5.1 Service Plans

We offer the following service plans:

• Free: 1 site, 1,000 consents/month, CookieSeal branding
• Pro (₹999/month): 10 sites, unlimited consents, no branding, custom colors
• Business (₹2,499/month): Unlimited sites, team access, priority support, API access, compliance reports

5.2 Billing and Payment

• Paid plans are billed monthly in advance
• All fees are non-refundable except as required by law
• Prices may change with 30 days written notice
• Late payments may result in service suspension
• You authorize automatic recurring charges to your payment method

5.3 Free Trial and Cancellation

• You may cancel your subscription at any time from your account dashboard
• Cancellation is effective at the end of the current billing period
• No refunds are provided for partial months of service
• Upon cancellation, your account will downgrade to the Free plan

6. Data Processing and Privacy

Our collection and use of personal data is governed by ourPrivacy Policy. For business customers handling EU personal data, we offer a separateData Processing Agreement.

You are responsible for ensuring your use of CookieSeal complies with applicable privacy laws in your jurisdiction. We provide tools to help with compliance but cannot provide legal advice.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by Hostao LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of content you upload to the Service. By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display your content solely for the purpose of providing the Service.

8. Service Availability

We strive to maintain high service availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

9. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL HOSTAO LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, INCURRED BY YOU OR ANY THIRD PARTY.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless Hostao LLC and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your content or data uploaded to the Service

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will cease immediately. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law provisions.

Any legal action or proceeding arising under these Terms will be brought exclusively in the state or federal courts located in Wyoming, and you hereby consent to personal jurisdiction and venue therein.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify registered users of material changes via email. Your continued use of the Service after changes become effective constitutes acceptance of the new Terms.

If you do not agree to updated Terms, you must stop using the Service and may cancel your account.
